All-Day Training #1: Evaluating and Negotiating Contractual Risk: The "Yellowstone" Way

Negotiating good business deals requires quick communication, swiftly weighing risk and proposing “good enough” alternatives that both parties can live with. While clauses can be debated ad nauseam, contract managers must get in the weeds and sort out complex interests between two parties quickly. In this practical workshop, participants will discuss the clauses that are usually the sticking points in their negotiations, and practice working in buyer and seller teams to assess risk and propose clause revisions and alternatives, present risk assessments to leadership and get to the best deal possible. This high energy workshop draws lessons and parallels to the show Yellowstone – whether you work in an office or on the wild frontier, you’ll enjoy practicing risk and negotiation skills in this engaging format. 

After this workshop, participants will be able to:

  • Define and mitigate performance risk, external risk, and contractual risk.

  • Evaluate, contract and rate actual risk clauses including indemnification, insurance, liability, and damages.

  • Recognize multiple risk perspectives

  • Prepare for a complex negotiation.

All-Day Training #2: Leadership Strategies for Contracting Professionals

Contract management is a dynamic profession that relies on strong leaders to create solutions for organizations, customers, and end-users. Half-Day Training #2: Subcontract Terms and Conditions: Deciding, Interpreting and Managing Compliance

This workshop is a unique opportunity for buyers and sellers to learn side by side. It also offers valuable perspective for agency buyers in how the requirements in the prime contract affect the compliance decisions, performance, and cost impact down the supply chain.

Flowdown requirements and other terms and conditions in subcontracts remain a point of confusion with real compliance, cost, and performance impact. If you are throwing in or accepting all the requirements of the prime, just to be sage you may be creating management challenges and adding costs you did not intend. As th eprime, you are also required to manage compliance with each requirement you include. If you are a subcontractor signing on the dotted line without fully understanding how ever requirement, you could be taking on unnecessary risk with real business impact. Join this hands-on half day workshop focused on terms and conditions requirements (one of many subcontractor management considerations) to practice making decisions about what requirements flow down from the prime to the subcontract and which do not. You'll examine the technical and compliance requirements of a prime contract as you consider each potential clause.

Once you have made your decisions, you'll build a plan for how you'll manage compliance with the terms of the subcontract.

  • Learn best practices in interpreting flowdowns that yield better responses to reduce risks & protect profitability
