Buying commercial products and services makes good business sense. When a product or service is available in the marketplace it means that it's already being offered by a pool of contractors competing to offer a readily available, reliable, and effective item. The government is encouraged to buy this way via FAR Part 12. Yet, why does a commercial procurement often become complicated by agencies reverting to a fully negotiated FAR Part 15 approach? Join this session for specific tips to avoid the temptation to overcomplicate and maximize the streamlining benefits of FAR Part 12. The session will start by establishing a common understanding of commercial products and services. Next, it will delve into the commercial market research process and how to prepare a sound solicitation that brings the right sellers to the table. B01 How to Buy the Cloud
Buying the cloud pushes contracting professionals to the fringes of the FAR. Is it Fixed Price? Is it Time and Materials? Cloud services are not like software licenses--they are contracted via a consumption model which means that you pay as you consume. This may feel completely backwards from usual risk-based contracting methods which price services up front and invoke fears of the the Anti-deficiency Act. The answer is a credit model in which agencies contract for credits which can be traded in for items from a catalog of cloud services. It can be confusing to structure contracts that price cloud credits and capture cloud catalogs offerings. Government contracting officers have a good problem – with more and more innovative acquisition tools available, they are expected to be able to make strategic decisions on which one to use. Selecting a non-traditional solicitation method is not an inherent trait but a skill that must be learned and practiced. This session will build that skill by exploring the many alternatives to the standard Request for Proposal (RFP) in both FAR-based settings and other more flexible situations including Commercial Solutions Opening, Broad Agency Announcements, or Program Solicitations, Comparing the attributes of each is key to selecting the most effective method and receive the proposal responses. G03: Ukraine’s Procurement Heroes
The surprising story of Ukraine’s procurement transformation began during the pro-democracy, anticorruption Maidan Integrity Revolution in 2014. Amid the uprising against corruption under then-President Victor Yanukovych, a group civic activists decided to overhaul one of the most corrupt areas of government: public procurement.
The cornerstone of this reform is an e-procurement system, ProZorro (“transparently” in Ukrainian), and a community of citizens and public buyers, Dozorro (“watchdog”), who analyze contracting data, flag high-risk deals and irregularities, and report them to public authorities. Created with the help of the European Bank for Reconstruction and Development (EBRD) and the U.S. Agency for International Development (USAID), ProZorro and Dozorro uncovered violations in more than 30,000 procurements worth $4 billion in the first three years. An organization’s contract department is at the center of a wheel, interacting with every other team, including the c-suite, technical experts, marketing, IT, etc. Contract mangers are mission-driven and ideally placed to find innovative ways to meet business goals. Workshop A03 Communicating the Acquisition Need - RFIs and Capability Statements
Join this fast-paced workshop to write and respond to Requests for Information (RFIs) in teams. You’ll leave ready to tackle the market research process with a new perspective on communicating across the table. Have you ever received a solicitation and wondered if the potential sellers were responding to the same need you thought you communicated? Why do buyers and sellers sometimes end up being so far off in their perception of the requirement? Enter the need for RFIs and seller capability statements, a critical and sometimes overlooked part of market research and acquisition planning. Buyers may skip RFIs to speed up the process, however, the result is usually the opposite—months or years and unintended costs are added trying to retrofit the requirements statement to the actual need. In this workshop you’ll practice getting this process right from the start! Government and industry will work together to develop RFI statements from the buyer’s perspective and play a seller responding to an RFI with a capability statement. You’ll see how effective your RFI was in real time based on how well seller groups were able to respond and get real time feedback from buyers on how well your seller capability statement addressed the RFI.

A problem is identified and immediately the conversation turns to one or two solutions that are comfortable and the team presses forward to choose one and divvy up the work. While this approach may work for simple problems it can stifle more creative solutions required to solve complex acquisition problems. Join this interactive workshop to try your hand at methods “innovation sherpas” used to ignite creativity on acquisition teams. P2SM: Innovation Alley - The Commercial Solutions Opening - How the Defense Innovation Unit’s Acquisition Process Works at the Speed of Business
Session Description: The Defense Innovation Unit, better known as DIU, was launched in 2015 to penetrate the untapped market of commercial technology for the Department of Defense (DoD) by bringing private investment and speed to the defense acquisition system. P2SM Innovation Alley - Army Contracting Procurement INsights (PIN) tool - The Key to Unlocking Strategic Contract Data
The Army has developed an analytic infrastructure to structure, index and discover relevant and previously unstructured data found in contract documents: the Contracting PIN (Procurement Insights) tool. PIN leverages artificial intelligence and enhanced methods to provide advanced analytic capability and as a result, strategic contract data insight to Army contracting leaders.
The Army awards billions of dollars across hundreds of thousands of contracts annually. Each contract file contains thousands of valuable data points including; Procurement Service Codes (PSCs) Contract Line Item Number (CLIN) data, contract clauses, Performance Work Statements and/or Statements of Objectives (SOO) and much more. Searching massive contract files comprised of various document formats to unlock strategic contract data insights such as: cost-savings opportunities, purchasing trends, and other analytics currently requires tedious manual, ad-hoc efforts that are not repeatable or scalable. As a result, leaders and decision-makers are not empowered with easily available and user-friendly information in real-time to make the best business decisions possible. Over the last 1.5 year, the Office of the Deputy Assistant Secretary of the Army (Procurement) Future Operations, Acquisition Innovation through Technology Team along with the Army Contracting Command Data Team partnered with the RAND Arroyo Center to create PIN. Workshop B04 Transform Your Acquisition Function for Enhanced Mission Performance
As the federal workforce shifts to a new future of work, transformation of the acquisition function becomes even more critical. As the federal workforce shifts to new ways of working (e.g., how they work, where they work, how they are structured), a whole-sale reimagining of our procurement organizations becomes even more critical, starting with organizational structure through to organizational roles and operating procedures. Acquisition transformation reduces silos between procurement organizations, programs, and C-Suite offices, supports lower siloed engagement frameworks ensures that dynamic collaborative conversations occur in real-time between procurement and programs to enable mission delivery, and enables and empowers a workforce that brings outcomes-oriented problem-solving skills to the table with the cross-functional acquisition team, customers, and industry partners. Without acquisition transformation, outdated, burdensome processes and structures persist leading to negative slack What is negative slack? and low morale in organizations which can impede mission delivery and organizational success. Join this session to learn to: 1) Effectively leverage transformation principles within your acquisition organization, principles such as identifying your future organizational vision, 2) Identify how to overcome common acquisition transformation pitfalls, such as a lack of communication around the acquisition change and 3) Design a framework for acquisition transformation for your organization. You will leave the session with tools and techniques to design, implement, and lead, and support acquisition transformation to achieve extraordinary mission outcomes, including a framework to design a future vision for your acquisition organization.

P2SM Innovation Alley - Immersive Commercial Acquisition Program
Have you ever wondered how to get innovative commercial ideas and capabilities into your Department of Defense (DoD) organization?
Many recognize the proliferation of unique commercial technology and its utility in various applications. In fact, the DoD created the Defense Innovation Unit (DIU) for this very reason. Specifically, the DoD charged DIU to develop ways to capitalize on these independent, commercial investments and field dual-use technologies across the Department. DIU recognized it needed to modify the traditional defense acquisition process to keep pace with commercial product cycles and entice non-traditional defense vendors to accomplish this goal. To that end, DIU developed a successful acquisition approach called the Commercial Solutions Opening (CSO), which relies on the Other Transaction (OT) authority to rapidly prototype, field, and scale commercial dual-use technology that meaningfully impacts the warfighter. DIU is partnering with the Defense Acquisition University (DAU) to train acquisition professionals on this streamlined acquisition approach. DIU and DAU understand that DIU's process is different from the traditional defense acquisitions, and, for this reason, DAU and DIU created this partnership to immerse competitively selected acquisition professionals within DIU. The program’s goal is that these participants will learn first-hand how to acquire commercial technology over the course of a year and take this knowledge back to their home organization. History has always relied on explorers and risk-takers to advance civilizations. Influencers are occasionally ‘first there,’ but wholesale innovations are few and far between. Rather, influencers often leverage past failures and successes to expand and shape solutions within a “Yes, and World.” Think of influencers as thermostats affecting change in their environment.
Thermostats, unlike thermometers, make a difference. Similarly, influencers fuel motivation and commitment in various ways. With an emphasis on "back to basics," on-the-job training (OJT) plays a major role in how an organization trains or retrains employees. To be truly effective, OJT requires more thought and preparation than just having a trainee shadow an experienced worker to watch what they are doing. One of the most successful ways to do this is through a structured coaching-based OJT program. Join this session to learn how establishing a coaching-based OJT program at your organization can lead to meaningful employee development, effective relationships, and increased performance. This discussion will briefly cover the requirements of contract closeout, focusing in on flexibly priced contracts as those are the most cumbersome to close. We will give an overview of the administrative requirements but spend the most time discussing the financial closeout piece, quantifying the number of contracts and potential over/under bill to be given to the government. Dine-Arounds
NCMA has organized dine-around groups for dinner on Monday, July 18, at various restaurants in Chicago. Each of the dinner groups have room for 6–10 people and will be hosted by someone from NCMA HQ or the NCMA Chicagoland Chapter, but please be aware everyone is responsible for their own tab and transportation. Groups will meet in the Hyatt Regency lobby at 5:40pm for a 6:30pm reservation. Sign-up here.
