The words written (or not written) in the Present Levels of Academic and Functional Performance (PLAAFP) section of the IEP can be the difference between winning or losing a due process hearing, resolving a dispute with a parent, and providing FAPE. The IDEA, however, does not define academic achievement or functional performance. Instead, it gives flexibility to IEP teams regarding how to determine and document a student's present levels. Additionally, school boards are responsible for paying a prevailing parent’s attorney’s fees. Since 2008, the IDEA regulations have allowed parents to revoke their original consent to placement and have their child exited from special education altogether. Although this happens rarely, when it does occur, it raises significant legal questions. Attorney Jose Martín will answer these questions plus detail what steps the school must take when parents revoke consent.
