ADR2 | Mediation: Successfully Navigating Intercultural Waters
Part of mediation is enabling parties in conflict to dialogue toward a place of mutual peace and understanding. With social protocols in place regarding various societal cultures, it is often difficult to work through cultural concerns regarding what is appropriate and what is taboo. Mediators must ensure that the dialogue is inclusive for all of the parties. Additionally, the task of a neutral third-party is to set the tone, put in place rules of engagement, and establish a safe space (in-person or virtually) that enables the parties to communicate toward possible resolution. This interactive workshop, led by experienced EEO and ADR practitioners, will explore these concerns and offer best practices for safely and effectively navigating the cultural waters. Attendees will participate in role playing and case studies focusing on realistic scenarios involving intercultural situations brought to meditation.

HR9 | The 2024 Election Season: What Every Federal Employee Needs to Know About the Hatch Act
The presidential election season is in full swing, and federal employees are interested in engaging with political parties and campaigns to the extent permitted under the Hatch Act. This session will answer the questions most frequently submitted to the U.S. Office of Special Counsel’s Hatch Act Unit and provide an update about recent case developments, advisory opinions, and novel issues. This session will address when and how workplace discussions about politically-charged issues might implicate the Hatch Act; how the Hatch Act applies to discussions about international issues, such as the Israel-Hamas conflict; what employees need to consider when running for elected office; and whether and how employees can become involved with political campaigns. Because the Hatch Act’s rules apply to elections at the national, state, and local level, this session will also cover Hatch Act violations related to each of those types of elections.

Critical to being an effective negotiator is the recognition that humans process information at an emotional level first, and that rational processes such as analyzing, problem-solving, critical thinking, and negotiating follow. Reaching mutually agreeable outcomes without damaging the relationship of those involved, requires working through the negotiator’s own internal emotions (their locus of control) to utilize constructive communication approaches and then, insofar as possible, impacting their negotiating partner to also respond constructively. LR/ER4 | Transform Employee Relations Service Delivery for a High-Demand Workplace
Does your LR/ER office struggle to manage the flood of open cases and new inquiries? Come learn how the Internal Revenue Service's LERN office leveraged technology to transform its traditional employee relations service delivery model into a multi-tiered customer-centric operation by expanding self-service options and establishing a centralized group to help employees and managers address common workplace concerns. In July 2023, LERN implemented this new model to expand access to employee relations support and free up experienced staff to address its inventory of 3,322 open cases, which included performance issues, disciplinary actions, adverse actions, grievances, and third-party appeals. LERN estimates that, by August 2024, this new multi-tier approach will reduce escalations by more than 30 percent. LERN will operate under this new model in tandem with existing case processing practices to drive case cycle times down to a successful rate.

LR/ER2 | Mock Arbitration Hearing on Post-Pandemic Issues
This engaging, interactive workshop will first focus on the federal sector arbitration process and then on tools the advocate can use to select an arbitrator from the panel provided. Using a list of fictional arbitrators, the presenters will explore the art of arbitrator selection and engage with attendees on various criteria that may be used. The remainder of the session will present teaching points through a mock arbitration involving post-pandemic issues. The hearing will involve the issues of past practice and contract clauses developed during the pandemic and the agency’s post pandemic changes. The union invokes arbitration in its institutional role to address the agency changes. A role play will go through the life of this arbitration from opening statements to final decision. The presenters will also cover concerns that arise during the hearing, such as objections, the standard of evidence/burden of proof, federal sector distinctions, sequestration of witnesses, the necessity of briefs, and dealings with the arbitrator.

HR5 | Be an HR Superhero: Learn How to Rescue Managers From Common Hiring-Related Prohibited Personnel Practices
One of the many responsibilities of HR professionals is to provide managers the guidance they need to avoid engaging in illegal hiring practices. This breakout session will provide HR staff with the tools required to guide managers through – and rescue them from, if necessary – the minefield of hiring-related prohibited personnel practices (PPPs). Ms. Gullick will explain the statutory elements of the most common hiring PPPs. She will also examine ways to have difficult but constructive conversations with hiring officials by using everyday language to explain legal precedent, practicing communication techniques like active listening, and speaking truth to managers. Ms. Gullick also will focus on communicating with and influencing the gamut of managers, from first-line supervisors to top agency officials. Common hiring scenarios that may result in PPPs will be utilized to practice effective communication techniques and to brainstorm how to steer the hiring process out of the PPP danger zone.

EEO8 | No Crystal Stair: A Dialogue to Identify Workplace Inequities and Ways to Overcome Them
In the early 20th century, Harlem renaissance poet Langston Hughes wrote the poem “Mother to Son,” in which the mother compares her life, and the journey of minorities and people of color, to a dilapidated staircase that is difficult to climb. In the poem, the mother advises the son that even though the staircase is not crystal and no easy climb, it is important to keep going. More than 100 years after this poem was written, and 60 years after passage of the Civil Rights Act, we have seen progress, but we're still climbing that “staircase,” still working to address employment discrimination, including systemic racism and gender inequality. This interactive session, led by experienced FDR presenters Roslyn Brown and Oliver Allen, creates a safe space to discuss challenges to fairness and equity in the current federal workplace. Ms. Brown and Mr. Allen, along with the attendees, will identify and explore the microinequities, “isms,” and "elephants in the room" that impact the climb up the staircase and then work together to figure out constructive ways to overcome them.

ATY12 | Potential Remedies in WPA Appeals
Under the Whistleblower Protection Act, existing law presents a party seeking corrective action with a wide range of potential remedies that are available to an appellant who prevails in a WPA appeal. From a defending agency's perspective, agency counsel needs to be aware of the extent of the potential damages an agency will face in the event an administrative judge finds the agency liable for retaliation under the WPA. To further complicate matters, different statutory remedies require different evidentiary standards of proof to establish entitlement to those remedies. In this session, OSC attorneys and MSPB AJs will explain the different statutory remedies available under the WPA, as well as the standard for establishing entitlement to those remedies.

Mastering the Art of DEIA Strategic Plans: A Cookbook for Advancing Outcomes
It's been more than two years since agencies were required to submit their DEIA strategic plans to OPM. By now, many of you, as practitioners and subject-matter experts, have found some initiatives were fruitful and others fell short of expectations. This session will help attendees reach better outcomes with a potluck of ideas and strategies. Head chefs Roslyn Brown and Oliver Allen will bring 20 valuable tips for cooking up success.
