ATY8 | Effectively Implementing Pregnant Workers Fairness Act Requirements

The Pregnant Workers Fairness Act requires agencies to reasonably accommodate the known limitations related to the pregnancy, childbirth, or related medical conditions of a qualified employee, unless the accommodation would be an undue hardship. Although the law went into effect in June 2023, federal practitioners are still working to understand its parameters, including how the reasonable accommodation requirements differ from those of the Rehabilitation Act. The presenters will discuss the key differences in the laws, including whether a pregnant employee’s inability to temporarily perform an essential function renders them otherwise qualified to hold a position. They will also focus on predictable assessments under the law.

HLE9 | Suitability Determinations and Actions under the Trump Administration

Suitability determinations are directed toward whether the character or conduct of an individual is such that their employment would adversely affect the integrity or efficiency of the service. The suitability regulations were recently revised in January 2025. Subsequently, President Trump delegated to the Office of Personnel Management the authority to make suitability determinations and take suitability actions based on post-appointment conduct. Previously, suitability determinations and actions were based only on pre-appointment conduct. OPM was also tasked with further amending the suitability regulations to carry out this new delegation of authority. This session will provide an overview of the changes to the suitability regulations, and the process for making determinations and taking actions under the Trump administration.

HLE4 | Applying the Douglas Factors in Adverse Actions

One of the most difficult decisions in an adverse action is determining the appropriate penalty for an employee’s misconduct. Nearly 45 years ago, the U.S. Merit Systems Protection Board decided Douglas v. VA, which set forth 12 factors a deciding official should consider in arriving at a reasonable penalty. While the factors seem straightforward, through case law, the U.S. Merit Systems Protection Board has provided guidance for each factor as to what can be considered aggravating, mitigating, neutral or not applicable. Keeping up with this guidance is critical for penalty mitigation. Robert Erbe will walk participants through the case law on each of the factors and how a deciding official should apply them.
