Claims Fraud Prevention
This session explores effective strategies to identify and prevent fraudulent claims through oversight, early intervention, and legal frameworks. Topics include the role of independent investigations by agencies such as the Inspector General and Attorney General, as well as the use of RICO actions against fraud. We will examine early detection techniques including video retrieval, surveillance, social media monitoring and witness interviews. Additionally, we will review key state laws and legislative proposals. This session will conclude with best practices for organizations.

Navigating Change in Washington
The regulatory and funding environment in which public transit agencies operate is changing. President Trump has issued a series of Executive Orders and Presidential Memoranda that, together with U.S. Department of Transportation orders, directly impact public transportation. APTA continues to seek Administration guidance to better understand these directives. Ward McCarragher, APTA’s Vice President of Government Affairs, leads this discussion of these Executive Actions and how recent changes may impact this year’s appropriations and surface transportation authorization processes. A panel of transit agency counsels will weigh in on what they are hearing at the local level and how their agencies are implementing the directives.

State Safety Oversight Panel
When Congress created the State Safety Oversight Program, all states with fixed guideway transportation systems were required to create State Safety Oversights (SSO) agencies to fulfill the statutory mandate and comply with the newly adopted regulations. Each State, each system is, of course, different and States have all been required create an oversight office or, in some cases, an entirely new agency, to fulfill that mandate. The panelists will discuss their respective roles, how their agencies came to be, and what challenges they face that may be the same as or different from their sister States.

The Post-Chevron Regime: A Litigation Review Following Loper Bright and Developments at USDOT/FTA
A series of important administrative law Supreme Court rulings in 2024 dramatically altered the federal government’s regulatory landscape. Highlighted by the Loper Bright decision, the Court established new standards by which the judicial branch reviews challenges to an agency’s interpretation of their own statutory authority when issuing regulations. This panel will review the major administrative law rulings from last term and how federal courts around the country have begun to apply those rulings. In addition, FTA/USDOT officials will review regulatory actions over the past year and preview what’s to come.

President Trump has signed dozens of Executive Orders (EOs) covering a broad range of issues, impacting diversity, equity, and inclusion programs, and government contracts and grants. With many major businesses changing their stance to comply with these new EO’s, and recent legal challenges having direct consequences on the Disadvantaged Business Enterprise (DBE) Program, what are the implications for the future for transit agencies and vendors that conduct business with transit agencies? This session is designed to explore the shifts in the litigation landscapes through providing litigation updates on local, state, and federal laws, as well as discuss compliance measures and DOT guidance. The session will also address the major compliance revisions implemented by the USDOT to the DBE program (49 C.F.R. Part 26). The Future of Intercity Passenger Rail – The Times They are a’ Changin...Maybe?
The landscape in which the intercity rail network operates is changing, to be sure. The Biden administration brought enormous funding and support for intercity rail, and Amtrak has aggressively promoted expansion and improvement of its network to take advantage of that support. New regulations governing on-time performance and associated incentives and penalties have affected the relationship between Amtrak and its host railroads. The outlook for the future is affected in as yet undetermined ways by the change in administration in Washington as we await information about how the role of rail passenger service will be viewed going forward. Panelists will discuss how their organizations are reacting to changes as they unfold, how (if at all) their relationships with carriers that share the road with them might be changing, and how state funding is or can be relied upon as a vehicle to address the impacts of the changing federal landscape.
